Personal injury claims involve both liability and damage analysis. At Godin & Baity we recognize that, for example, an automobile accident involves a determination of the impact that accident had on the passengers, as well as an analysis of the medical treatments obtained, and the mitigating factors, including pre-existing medical conditions, that may lessen the alleged damages. This analysis, recognizing the importance of every detail available, resulted in a defense verdict for a client recently after a two and a half week jury trial. The plaintiff had demanded well in excess of a million dollars.

Similarly, in a premises liability case, where a person slips while shopping in a department store, the analysis includes a determination of whether that store had notice of an alleged dangerous condition that caused the patron to slip, in conjunction with the treatment received. In a recent premises liability case, we succeeded on a summary judgment motion where our client had no notice of an alleged dangerous condition, resulting in dismissal of all claims against our client.
